These terms and conditions (“Official Rules”) govern the Whole Milk Free T-Shirt Giveaway (the “Giveaway”). By participating, each entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Giveaway.
The Sponsor of the Giveaway is Gale Partners LLP as agent for the National Fluid Milk Processor Promotion Board (“Sponsor”), with an address at 1 WTC, Floor 62, New York, NY, 10007.
This Giveaway is not sponsored, endorsed, administered by, or associated with TikTok or Meta (including Instagram). By participating, entrants understand that they are providing information to Sponsor, not to TikTok Ltd. (“Tik Tok”),Meta Platforms, Inc. (“Meta”) or Instagram.
Although the Sponsor’s promotional video is posted by John Morgan of Morgan & Morgan, the Giveaway is sponsored solely by the Sponsor. Morgan & Morgan and John Morgan are not sponsors of the Giveaway.
The Giveaway begins when the Sponsor’s promotional video, posted by John Morgan of Morgan & Morgan, is first posted on TikTok and Instagram on August 25, 2026, at 9:00 a.m. ET and ends when the first fifty (50) eligible entrants have completed all required steps described below, or at 9:00 a.m. ET on August 31, 2026, whichever occurs first (the “Giveaway Period”).
Sponsor’s records will be the official timekeeping mechanism for the Giveaway.
The Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old, or the age of majority in their state of residence, at the time of entry. Employees, officers, directors, agents, and representatives of the National Fluid Milk Processor Promotion Board, Gale Partners LLP, their respective affiliates, advertising and promotion agencies, and each of their immediate family members (spouse, parents, siblings, children, and their respective spouses, regardless of where they reside) or persons living in the same household (whether or not related) are not eligible to participate.
The Giveaway is void where prohibited or restricted by law.
To participate, an eligible person must complete all of the following steps during the Giveaway Period:
1. Go to www.hey-milk.com; and
2. Complete the submission form with all required details, including their mailing address and phone number.
The first fifty (50) eligible entrants who properly submit their complete mailing address through the website identified above, as determined by Sponsor based on Sponsor’s records, will receive one prize, subject to verification of eligibility and compliance with these Official Rules.
Limit one (1) prize per person and per household.
Incomplete, late, misdirected, illegible, undeliverable, or otherwise noncompliant entries may be disqualified. Sponsor is not responsible for lost, delayed, misdirected, failed, incomplete, or undeliverable submissions or entries, or for any technical, network, website, internet, or other error or failure.
No purchase or payment is required to participate in the Giveaway or receive a prize. Participation is free; entrants pay only their own standard data or internet access rates, if any, which are charged by their carrier or internet provider and not by or shared with Sponsor. Sponsor does not use any premium-rate, short-code, or pay-per-call/pay-per-text billing in connection with the Giveaway.
Each verified recipient will receive one free T-shirt selected by Sponsor. Prizes will be fulfilled and shipped by Printful, Sponsor’s fulfillment partner, within approximately six to eight (6–8) weeks after verification. Printful may use the recipient’s phone number to provide shipping and delivery updates. Sponsor is not responsible for prizes that are lost, stolen, damaged, or misdirected after shipment.
Approximate retail value (“ARV”) of each prize: $25.00.
Total ARV of all prizes: $1,250.00.
Size, color, design, and style of T-shirt are subject to availability and will be determined by Sponsor in its sole discretion unless otherwise stated. No substitution, transfer, or cash equivalent of any prize is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.
Prize recipients are solely responsible for any federal, state, or local taxes, fees, or other costs associated with prize acceptance or use, except for standard shipping costs, which will be paid by Sponsor.
This Giveaway is limited to the first fifty (50) eligible entrants who complete all required steps in accordance with these Official Rules.
Potential recipients are subject to verification by Sponsor. Sponsor may require a potential recipient to provide additional information reasonably necessary to confirm eligibility, identity, mailing address, or compliance with these Official Rules. A potential recipient must respond to any such request within forty-eight (48) hours or the prize may be forfeited.
If a potential recipient is found to be ineligible, fails to comply with these Official Rules, provides incomplete or inaccurate information, or cannot receive the prize for any reason, Sponsor may disqualify that person and, time permitting, award the prize to the next eligible entrant in order of receipt.
Information collected from entrants, including mailing addresses and phone numbers, will be used to administer the Giveaway, verify eligibility, communicate with entrants, and fulfill prizes. Prize recipients’ mailing addresses and phone numbers may be shared with third parties, including shipping carriers and fulfillment vendors such as Printful, as necessary to fulfill and deliver prizes and provide shipping and delivery updates.
Entrants should not submit sensitive personal information other than the mailing address and phone number required for prize fulfillment and delivery updates. Information collected in connection with the Giveaway will be handled in accordance with the Sponsor’s privacy policy, available at https://milkpep.org/privacy-policy/.
Except where prohibited by law, by accepting a prize, each recipient grants Sponsor and its designees the right to use the recipient’s name, likeness, city and state of residence, TikTok and Instagram usernames, and statements about the Giveaway for advertising, promotional, and publicity purposes in any media now known or later developed, without additional compensation, notice, or approval.
Sponsor reserves the right to cancel, suspend, modify, or terminate the Giveaway if fraud, technical failures, human error, legal restrictions, platform restrictions, acts of God, pandemic, government action, or any other factor beyond Sponsor’s reasonable control impairs the integrity, administration, security, fairness, or proper operation of the Giveaway, as determined by Sponsor in its sole discretion.
Sponsor reserves the right to disqualify any individual who Sponsor determines, in its sole discretion, has tampered with the entry process, violated these Official Rules, acted in an unsportsmanlike or disruptive manner, or attempted to undermine the legitimate operation of the Giveaway.
Sponsor’s failure to enforce any term of these Official Rules does not constitute a waiver of that provision.
By participating, entrants agree, to the fullest extent permitted by applicable law, to release, discharge, and hold harmless Gale Partners LLP, the National Fluid Milk Processor Promotion Board, Morgan & Morgan, TikTok, Meta, Instagram and their respective affiliates, advertising and promotion agencies, service providers, prize suppliers, and each of their respective officers, directors, employees, agents, representatives, successors, and assigns from and against any claim, liability, loss, damage, injury (including death), cost, or expense (including reasonable attorneys’ fees) arising out of or relating to participation in the Giveaway or the acceptance, possession, use, or misuse of any prize, including, without limitation, claims based on negligence, warranty, or strict liability.
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor, will be governed by the laws of the State of New York, without giving effect to conflict-of-law principles.
Except where prohibited by law, entrants agree that any disputes, claims, or causes of action arising out of or connected with the Giveaway or any prize will be resolved individually, without resort to any form of class action, and exclusively in the state or federal courts located in New York, New York. TO THE FULLEST EXTENT PERMITTED BY LAW, ENTRANTS WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT ANY DAMAGES RECOVERABLE SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, AND IN NO EVENT SHALL ENTRANTS BE ENTITLED TO CONSEQUENTIAL, PUNITIVE, INCIDENTAL, OR SPECIAL DAMAGES, OR ATTORNEYS’ FEES.
